This website is operated by BB Consumers Pte Ltd ("bback", "we", "us", "our"). Throughout the Site, the terms "we", "us" and "our" refer to BB Consumers Pte Ltd. We offer this Site, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting the Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional terms, conditions and policies referenced here or available by hyperlink. These Terms apply to all users of the Site.

Please read these Terms carefully before using the Site. If you do not agree to all of them, you may not access the Site or use any Service.

We may update, change or replace any part of these Terms by posting updates to this page. It is your responsibility to check this page from time to time. Your continued use of the Site after changes are posted means you accept those changes.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least 18 years of age.

Our products are dietary supplements intended for adults. They are not medicines, and are not intended to diagnose, treat, cure or prevent any disease. Nothing on the Site is medical advice. If you are pregnant or breastfeeding, taking medication, or have a medical condition, consult a healthcare professional before use.

Our products do not prevent intoxication and are not a substitute for drinking responsibly. Do not drink and drive.

You may not use our products for any illegal or unauthorised purpose, nor may you, in using the Service, break any law in your jurisdiction, including copyright law. You must not transmit any worms or viruses or any code of a destructive nature. A breach of any of these Terms will result in immediate termination of your Service.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service to anyone, for any reason, at any time.

You understand that your content (not including payment information) may be transferred unencrypted and may involve transmission over various networks, and changes to conform to the technical requirements of connecting networks or devices. Payment information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service, without our express written permission.

SECTION 3 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on the Site is not accurate, complete or current. The material on the Site is provided for general information only and should not be relied upon as the sole basis for making decisions. The Site may contain historical information, which is provided for reference only and is not current. We may change the contents of the Site at any time, but we are under no obligation to update it.

SECTION 4 — PRODUCTS, PRICES AND AVAILABILITY

All prices shown on the Site are in Malaysian Ringgit (RM) and include any applicable taxes unless stated otherwise. Delivery charges are shown separately at checkout.

Products are offered subject to availability. We reserve the right to limit the quantities of any products we offer, to discontinue any product, and to change prices at any time without notice.

We have made every effort to display the colours and images of our products accurately. We cannot guarantee that your display will show colours accurately.

We do not warrant that the quality of any product you purchase will meet your expectations, or that any errors in the Service will be corrected.

SECTION 5 — ORDERS AND BILLING

We reserve the right to refuse or cancel any order you place with us. We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, the same payment method, or the same billing or delivery address.

In the event we change or cancel an order, we may attempt to notify you using the email address, billing address or telephone number provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases made on the Site, and to update your account and other information promptly, so that we can complete your orders and contact you as needed.

SECTION 6 — DELIVERY

We deliver within Malaysia only, to both West and East Malaysia. Delivery times, charges and the free delivery threshold are set out in our Shipping Policy, which forms part of these Terms.

For customers outside Malaysia, our products are available from bback.co (Singapore) and bback.hk (Hong Kong).

SECTION 7 — RETURNS AND REFUNDS

Our Refund and Returns Policy forms part of these Terms. Please read it before making a purchase.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools over which we have no control. You acknowledge that we provide access to such tools "as is" and "as available", without any warranties or endorsement. Any use you make of optional tools is entirely at your own risk, and you should review the relevant third party's terms.

Certain content, products and services available via the Service may include material from third parties. Third-party links on the Site may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for any harm or damages related to the purchase or use of goods, services or content of any third-party websites. Please review their policies and practices carefully before you engage in any transaction. Complaints, claims or questions regarding third-party products should be directed to the third party.

SECTION 9 — USER COMMENTS AND SUBMISSIONS

If you send us creative ideas, suggestions, proposals, plans, reviews or other materials, whether at our request or not, you agree that we may at any time, without restriction, edit, copy, publish, distribute and otherwise use them in any medium, without obligation to compensate you or to keep them confidential.

You agree that your comments will not violate any right of any third party, and will not contain unlawful, abusive, defamatory, obscene or otherwise objectionable material, or any computer virus or malware. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us as to the origin of any comments. You are solely responsible for any comments you make and their accuracy.

Your submission of personal data through the Site is governed by our Privacy Policy, which forms part of these Terms.

SECTION 11 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on the Site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate, at any time without prior notice, including after you have submitted your order.

SECTION 12 — PROHIBITED USES

In addition to other prohibitions set out in these Terms, you are prohibited from using the Site or its content: for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any regulations, rules, laws or local ordinances; to infringe upon or violate our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate; to submit false or misleading information; to upload or transmit viruses or any other type of malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

SECTION 13 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

Except as expressly stated by us, the Service and all products delivered to you through the Service are provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement, except to the extent such exclusion is not permitted by Malaysian law, including the Consumer Protection Act 1999 and the Sale of Goods Act 1957. Nothing in these Terms excludes or limits any right you have under Malaysian law that cannot be excluded or limited.

To the fullest extent permitted by law, in no case shall BB Consumers Pte Ltd, our directors, officers, employees, affiliates, agents, contractors, suppliers or service providers be liable for any indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the Service or any products procured using the Service. Where liability cannot be excluded, our total liability to you shall not exceed the amount you paid for the product giving rise to the claim.

SECTION 14 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless BB Consumers Pte Ltd and our affiliates, officers, directors, agents, contractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 15 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. The remaining provisions remain in full force and effect.

SECTION 16 — TERMINATION

The obligations and liabilities of the parties incurred prior to termination survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our Services, or by ceasing to use the Site.

SECTION 17 — ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with any policies posted on the Site, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements or communications.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 18 — GOVERNING LAW

These Terms, and any separate agreements by which we provide you Services, shall be governed by and construed in accordance with the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the courts of Malaysia.
